AXELLEGAL's team defended the client's interests and obtained an acquittal for him!

On December 29, 2021, the Novozavodskyi District Court of Chernihiv delivered a verdict in which the court found AXELLEGAL's client not guilty and acquitted him of a criminal offense under Part 3 of Article 212 of the Criminal Code of Ukraine.

AXELLEGAL's client was accused of intentional tax evasion for land totaling UAH 9,100,607.31.

Everything is classic! The city council, with the support of the regional prosecutor's office and the participation of the pre-trial investigation body, tried to recover from the company an overstated amount of rent payment for land, parts of which are used by other business entities, despite the fact that the land plot had not been formed at all.

This is because the company did not agree to the "conditions" that the Chernihiv City Council grant a permit for the production of technical documentation on land management. Subsequently, the Chernihiv City Council actually refused to grant the company the relevant permit due to a disputed understanding of the legal nature of the facts that affect the algorithm for determining and calculating the amount of money to be paid for land.

In the course of the case, AXELLEGAL's team proved that criminal proceedings are a hand tool in the hands of the city council, and the evidence collected within the proceedings by the pre-trial investigation body is inadmissible.

The lawyers proved that the relations between the company and Chernihiv City Council are exclusively civil law and can be resolved in commercial proceedings, as evidenced by national court practice. The full text of the verdict is available at link.
