
Trends in business protection in 2022: lawyer's advice
Dmytro Syryko, Senior Partner at AXELLEGAL Law Firm, spoke in his interview for Yurydychna Praktyka Publishing House on how to protect your business and prevent "nightmares" from law enforcement agencies.
Business protection is a set of measures, including preventive measures, aimed at both regulating and stabilizing the company's internal environment and protecting it from the impact of external factors. It is this understanding of the term that we are currently moving towards in our country. And this, in fact, can be called a key change: a systematic approach and work on business protection in a broad sense and on an ongoing basis, rather than "firefighting", are gradually becoming the trend.
If external threats to your business are difficult to plan for, you should follow the minimum rules:
The first is to monitor the situation: court registers, the Unified State Register, and, of course, the Internet for news on the topic.
The second is to audit your own documentation and files. Any inaccuracies can play against the business later.
Thirdly, when we take a client under our protection, we immediately ask for a list of counterparties to check them against all open registers for criminal cases and other legal proceedings.
This is a small set of preventive measures that should be repeated every time with each new counterparty and regularly monitor changes with old counterparties and in your company. This is a kind of legal hygiene for business.
It is imperative to acquire contacts of specialized attorneys so that in case of emergency you can immediately contact them, rather than urgently looking for recommendations from your friends. Of course, if "trouble comes to the house," and no one is immune from this, you should be prepared. This will increase your chances of protection and help you save money.
