The legislator increased the responsibility of businesses for advertising on illegal resources that distribute pirated content.<\/p>\n<hr data-start=\"515\" data-end=\"518\" \/>\n<h2 data-start=\"520\" data-end=\"549\">What is the essence of the innovations?<\/h2>\n<p data-start=\"551\" data-end=\"667\">The new rules are aimed at <strong data-start=\"578\" data-end=\"631\">termination of financial support for pirate sites<\/strong> through advertising budgets. From now on:<\/p>\n<ul data-start=\"669\" data-end=\"1086\">\n<li data-start=\"669\" data-end=\"789\">\n<p data-start=\"671\" data-end=\"789\">\ud83d\udccc <strong data-start=\"674\" data-end=\"705\">Advertisers and intermediaries<\/strong> are obliged to check more carefully which platforms their advertising is placed on.<\/p>\n<\/li>\n<li data-start=\"790\" data-end=\"931\">\n<p data-start=\"792\" data-end=\"931\">\ud83d\udccc <strong data-start=\"795\" data-end=\"823\">It is forbidden to cooperate<\/strong> with websites that illegally distribute movies, music, books, software, or TV products.<\/p>\n<\/li>\n<li data-start=\"932\" data-end=\"1086\">\n<p data-start=\"934\" data-end=\"1086\">\ud83d\udccc <strong data-start=\"937\" data-end=\"959\">Advertising agencies<\/strong> and networks are responsible for placing ads on \"infringing sites\" even if the client did not explicitly request it.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1088\" data-end=\"1192\">Thus, the legislator is trying to deprive pirated resources of their main source of income - advertising.<\/p>\n<hr data-start=\"1194\" data-end=\"1197\" \/>\n<h2 data-start=\"1199\" data-end=\"1239\">How will pirated resources be identified?<\/h2>\n<p data-start=\"1241\" data-end=\"1442\">It is planned to create <strong data-start=\"1266\" data-end=\"1301\">a special list of websites<\/strong>that infringe copyright. It will be formed and updated by the relevant body (with the participation of right holders and industry associations).<\/p>\n<p data-start=\"1444\" data-end=\"1582\">Advertisers and agencies are advised to rely on this list when choosing platforms. Otherwise, there is a risk of financial sanctions.<\/p>\n<hr data-start=\"1584\" data-end=\"1587\" \/>\n<h2 data-start=\"1589\" data-end=\"1618\">Business responsibility<\/h2>\n<p data-start=\"1620\" data-end=\"1665\">Violation of the new requirements can be costly:<\/p>\n<ul data-start=\"1667\" data-end=\"1852\">\n<li data-start=\"1667\" data-end=\"1724\">\n<p data-start=\"1669\" data-end=\"1724\">\ud83d\udcb0 fines for advertising on pirated websites;<\/p>\n<\/li>\n<li data-start=\"1725\" data-end=\"1773\">\n<p data-start=\"1727\" data-end=\"1773\">\u2696\ufe0f possible lawsuits from copyright holders;<\/p>\n<\/li>\n<li data-start=\"1774\" data-end=\"1852\">\n<p data-start=\"1776\" data-end=\"1852\">\ud83d\udcc9 reputational risks for brands associated with illegal content.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1854\" data-end=\"1994\">At the same time, a \"protective mechanism\" has been created for businesses - if advertising platforms are properly checked, liability can be minimized.<\/p>\n<hr data-start=\"1996\" data-end=\"1999\" \/>\n<h2 data-start=\"2001\" data-end=\"2044\">What should advertisers and agencies do?<\/h2>\n<p data-start=\"2046\" data-end=\"2096\">To avoid problems, companies should start now:<\/p>\n<ol data-start=\"2098\" data-end=\"2450\">\n<li data-start=\"2098\" data-end=\"2192\">\n<p data-start=\"2101\" data-end=\"2192\"><strong data-start=\"2101\" data-end=\"2152\">Introduce internal policies for checking websites<\/strong>, where advertisements are placed.<\/p>\n<\/li>\n<li data-start=\"2193\" data-end=\"2265\">\n<p data-start=\"2196\" data-end=\"2265\"><strong data-start=\"2196\" data-end=\"2242\">Use official \"white lists\"<\/strong> of authorized resources.<\/p>\n<\/li>\n<li data-start=\"2266\" data-end=\"2375\">\n<p data-start=\"2269\" data-end=\"2375\"><strong data-start=\"2269\" data-end=\"2308\">Include in agreements with partners<\/strong> a clause prohibiting advertising on pirated sites.<\/p>\n<\/li>\n<li data-start=\"2376\" data-end=\"2450\">\n<p data-start=\"2379\" data-end=\"2450\"><strong data-start=\"2379\" data-end=\"2417\">Involve lawyers and media experts<\/strong> to audit advertising campaigns.<\/p>\n<\/li>\n<\/ol>\n<hr data-start=\"2452\" data-end=\"2455\" \/>\n<h2 data-start=\"2457\" data-end=\"2488\">Why is this important for the market?<\/h2>\n<p data-start=\"2490\" data-end=\"2560\">The introduction of \"anti-piracy\" changes has several positive consequences:<\/p>\n<ul data-start=\"2562\" data-end=\"2778\">\n<li data-start=\"2562\" data-end=\"2620\">\n<p data-start=\"2564\" data-end=\"2620\">\u2705 support for rights holders and legal media services;<\/p>\n<\/li>\n<li data-start=\"2621\" data-end=\"2665\">\n<p data-start=\"2623\" data-end=\"2665\">\u2705 Increased transparency of the advertising market;<\/p>\n<\/li>\n<li data-start=\"2666\" data-end=\"2706\">\n<p data-start=\"2668\" data-end=\"2706\">\u2705 creating fair competition conditions;<\/p>\n<\/li>\n<li data-start=\"2707\" data-end=\"2778\">\n<p data-start=\"2709\" data-end=\"2778\">\u2705 Approximation of Ukrainian legislation to European standards.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2780\" data-end=\"2899\">In the long run, this will reduce piracy in Ukraine and attract more investment in the creative industries.<\/p>\n<hr data-start=\"2901\" data-end=\"2904\" \/>\n<h2 data-start=\"2906\" data-end=\"2919\">Conclusion.<\/h2>\n<p data-start=\"2921\" data-end=\"3290\">The \"anti-piracy\" changes to advertising legislation are an important step in the fight against illegal content. Businesses should take the new requirements as responsibly as possible: <strong data-start=\"3095\" data-end=\"3194\">check advertising platforms, adapt internal procedures and take into account legal risks<\/strong>.
