However, in practice, procuring entities often include in tender documents <strong data-start=\"258\" data-end=\"284\">discriminatory requirements<\/strong>The conditions that unreasonably restrict business participation. Such conditions are contrary to the Law of Ukraine \"On Public Procurement\" and can be challenged through the permanent administrative board of the Antimonopoly Committee of Ukraine (AMCU).<\/p>\n<p data-start=\"508\" data-end=\"648\">In this article, we will look at how to identify discriminatory requirements, what protection mechanisms exist, and how businesses can effectively defend their rights.<\/p>\n<hr data-start=\"650\" data-end=\"653\" \/>\n<h2 data-start=\"655\" data-end=\"706\"><strong data-start=\"658\" data-end=\"706\">What are discriminatory requirements in procurement?<\/strong><\/h2>\n<p data-start=\"707\" data-end=\"769\">The following requirements of the tender documentation are discriminatory:<\/p>\n<ul data-start=\"770\" data-end=\"954\">\n<li data-start=\"770\" data-end=\"811\">\n<p data-start=\"772\" data-end=\"811\">limit the range of potential participants;<\/p>\n<\/li>\n<li data-start=\"812\" data-end=\"856\">\n<p data-start=\"814\" data-end=\"856\">create advantages for individual companies;<\/p>\n<\/li>\n<li data-start=\"857\" data-end=\"896\">\n<p data-start=\"859\" data-end=\"896\">not related to the subject of procurement;<\/p>\n<\/li>\n<li data-start=\"897\" data-end=\"954\">\n<p data-start=\"899\" data-end=\"954\">have no objective and rational justification.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"956\" data-end=\"981\">The most common examples:<\/p>\n<ul data-start=\"982\" data-end=\"1446\">\n<li data-start=\"982\" data-end=\"1058\">\n<p data-start=\"984\" data-end=\"1058\">requirement to provide <strong data-start=\"998\" data-end=\"1037\">certificates that are not mandatory<\/strong> in accordance with the law;<\/p>\n<\/li>\n<li data-start=\"1059\" data-end=\"1132\">\n<p data-start=\"1061\" data-end=\"1132\">availability requirements <strong data-start=\"1083\" data-end=\"1129\">Excessive number of equipment or employees<\/strong>;<\/p>\n<\/li>\n<li data-start=\"1133\" data-end=\"1205\">\n<p data-start=\"1135\" data-end=\"1205\">requirement of performance experience <strong data-start=\"1160\" data-end=\"1174\">identical<\/strong>rather than similar agreements;<\/p>\n<\/li>\n<li data-start=\"1206\" data-end=\"1271\">\n<p data-start=\"1208\" data-end=\"1271\">the requirement to provide certificates that <strong data-start=\"1235\" data-end=\"1268\">impossible to obtain in principle<\/strong>;<\/p>\n<\/li>\n<li data-start=\"1272\" data-end=\"1355\">\n<p data-start=\"1274\" data-end=\"1355\">installation <strong data-start=\"1287\" data-end=\"1315\">excessively tight deadlines<\/strong> performance of work or delivery of goods;<\/p>\n<\/li>\n<li data-start=\"1356\" data-end=\"1446\">\n<p data-start=\"1358\" data-end=\"1446\">the requirement to have production facilities in a particular region without proper motivation.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1448\" data-end=\"1515\">Such conditions narrow competition and violate procurement principles.<\/p>\n<hr data-start=\"1517\" data-end=\"1520\" \/>\n<h2 data-start=\"1522\" data-end=\"1576\"><strong data-start=\"1525\" data-end=\"1576\">Legal regulation and non-discrimination principles<\/strong><\/h2>\n<p data-start=\"1577\" data-end=\"1627\">The Law \"On Public Procurement\" clearly states:<\/p>\n<ul data-start=\"1628\" data-end=\"1814\">\n<li data-start=\"1628\" data-end=\"1681\">\n<p data-start=\"1630\" data-end=\"1681\"><strong data-start=\"1630\" data-end=\"1678\">all participants have equal rights and opportunities<\/strong>;<\/p>\n<\/li>\n<li data-start=\"1682\" data-end=\"1748\">\n<p data-start=\"1684\" data-end=\"1748\">to the customer <strong data-start=\"1694\" data-end=\"1745\">it is prohibited to set discriminatory requirements<\/strong>;<\/p>\n<\/li>\n<li data-start=\"1749\" data-end=\"1814\">\n<p data-start=\"1751\" data-end=\"1814\">the tender documentation must comply with <strong data-start=\"1789\" data-end=\"1811\">the subject of procurement<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1816\" data-end=\"1964\">The AMCU has repeatedly emphasized that customers must prove <strong data-start=\"1876\" data-end=\"1906\">the necessity of each requirement<\/strong>. If there is no justification, it is considered illegal.<\/p>\n<hr data-start=\"1966\" data-end=\"1969\" \/>\n<h2 data-start=\"1971\" data-end=\"2017\"><strong data-start=\"1974\" data-end=\"2015\">How to recognize a discriminatory requirement?<\/strong><\/h2>\n<p data-start=\"2019\" data-end=\"2062\">Entrepreneurs should check whether there is a requirement:<\/p>\n<ol data-start=\"2063\" data-end=\"2365\">\n<li data-start=\"2063\" data-end=\"2140\">\n<p data-start=\"2066\" data-end=\"2140\"><strong data-start=\"2066\" data-end=\"2082\">Proportional<\/strong> - whether it is necessary for the quality performance of the contract.<\/p>\n<\/li>\n<li data-start=\"2141\" data-end=\"2214\">\n<p data-start=\"2144\" data-end=\"2214\"><strong data-start=\"2144\" data-end=\"2159\">Objective<\/strong> - whether the requirement meets the customer's technical needs.<\/p>\n<\/li>\n<li data-start=\"2215\" data-end=\"2285\">\n<p data-start=\"2218\" data-end=\"2285\"><strong data-start=\"2218\" data-end=\"2234\">Realistic<\/strong> - whether the majority of market participants can fulfill it.<\/p>\n<\/li>\n<li data-start=\"2286\" data-end=\"2365\">\n<p data-start=\"2289\" data-end=\"2365\"><strong data-start=\"2289\" data-end=\"2301\">Legal<\/strong> - whether it complies with state standards, regulations and laws.<\/p>\n<\/li>\n<\/ol>\n<p data-start=\"2367\" data-end=\"2442\">If at least one criterion is violated, the requirement has signs of discrimination.<\/p>\n<hr data-start=\"2444\" data-end=\"2447\" \/>\n<h2 data-start=\"2449\" data-end=\"2500\"><strong data-start=\"2452\" data-end=\"2498\">Mechanism for appealing against discriminatory requirements<\/strong><\/h2>\n<h3 data-start=\"2502\" data-end=\"2578\"><strong data-start=\"2506\" data-end=\"2576\">1. Analysis of tender documents and preparation of requirements for the customer<\/strong><\/h3>\n<p data-start=\"2579\" data-end=\"2834\">The first step is to submit a request to the procuring entity to eliminate the illegal condition in the electronic procurement system. Filing a complaint with the AMCU<\/strong><\/h3>\n<p data-start=\"2877\" data-end=\"2966\">The complaint can be filed until the end of the bid submission period.<br data-start=\"2938\" data-end=\"2941\" \/>The complaint must contain:<\/p>\n<ul data-start=\"2967\" data-end=\"3095\">\n<li data-start=\"2967\" data-end=\"2986\">\n<p data-start=\"2969\" data-end=\"2986\">description of the violation;<\/p>\n<\/li>\n<li data-start=\"2987\" data-end=\"3013\">\n<p data-start=\"2989\" data-end=\"3013\">legal justification;<\/p>\n<\/li>\n<li data-start=\"3014\" data-end=\"3044\">\n<p data-start=\"3016\" data-end=\"3044\">references to the law;<\/p>\n<\/li>\n<li data-start=\"3045\" data-end=\"3069\">\n<p data-start=\"3047\" data-end=\"3069\">requirements for the customer;<\/p>\n<\/li>\n<li data-start=\"3070\" data-end=\"3095\">\n<p data-start=\"3072\" data-end=\"3095\">evidence of discrimination.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3097\" data-end=\"3159\">The complaint is filed electronically through the Prozorro.<\/p>\n<hr data-start=\"3161\" data-end=\"3164\" \/>\n<h3 data-start=\"3166\" data-end=\"3214\"><strong data-start=\"3170\" data-end=\"3212\">3. The amount depends on the type of procurement (goods\/services or works).
