Many of them were purchased on credit, and a logical question arises after the loss of the collateral: <strong data-start=\"324\" data-end=\"368\">whether it is possible to cancel loan obligations<\/strong>If the property is completely destroyed or stolen?<\/p>\n<p data-start=\"419\" data-end=\"600\">This article explains, <strong data-start=\"438\" data-end=\"471\">when the bank can write off a loan<\/strong>What documents need to be collected, how legislative mechanisms work, and what the borrower should do to avoid debt claims.<\/p>\n<hr data-start=\"602\" data-end=\"605\" \/>\n<h2 data-start=\"607\" data-end=\"680\"><strong data-start=\"610\" data-end=\"680\">1. Does the law provide for the cancellation of loans due to the destruction of collateral?<\/strong><\/h2>\n<p data-start=\"682\" data-end=\"857\">Ukrainian law does not contain an explicit provision that automatically writes off a loan in the event of the destruction of collateral.<br data-start=\"795\" data-end=\"798\" \/>Formally, the loan agreement continues to be in effect even if:<\/p>\n<ul data-start=\"858\" data-end=\"1030\">\n<li data-start=\"858\" data-end=\"913\">\n<p data-start=\"860\" data-end=\"913\">a mortgaged apartment or house was destroyed;<\/p>\n<\/li>\n<li data-start=\"914\" data-end=\"969\">\n<p data-start=\"916\" data-end=\"969\">a car that was pledged as collateral is destroyed or stolen;<\/p>\n<\/li>\n<li data-start=\"970\" data-end=\"1030\">\n<p data-start=\"972\" data-end=\"1030\">the property became unusable due to the hostilities.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1032\" data-end=\"1112\">However, there are <strong data-start=\"1046\" data-end=\"1059\">mechanisms<\/strong>The company's debt relief programs allow it to write off or restructure its debt:<\/p>\n<ol data-start=\"1113\" data-end=\"1586\">\n<li data-start=\"1113\" data-end=\"1251\">\n<p data-start=\"1116\" data-end=\"1251\"><strong data-start=\"1116\" data-end=\"1141\">Article 617 of the Civil Code of Ukraine<\/strong> - exemption from liability for insolvency if it arose due to force majeure (war).<\/p>\n<\/li>\n<li data-start=\"1252\" data-end=\"1334\">\n<p data-start=\"1255\" data-end=\"1334\"><strong data-start=\"1255\" data-end=\"1280\">Article 349 of the Civil Code of Ukraine<\/strong> - termination of ownership in case of destruction of property.<\/p>\n<\/li>\n<li data-start=\"1335\" data-end=\"1408\">\n<p data-start=\"1338\" data-end=\"1408\"><strong data-start=\"1338\" data-end=\"1363\">Article 593 of the Civil Code of Ukraine<\/strong> - termination of the pledge in case of loss of the item.<\/p>\n<\/li>\n<li data-start=\"1409\" data-end=\"1530\">\n<p data-start=\"1412\" data-end=\"1530\"><strong data-start=\"1412\" data-end=\"1447\">The Law on Consumer Lending<\/strong> - a ban on demanding additional payments in circumstances beyond the borrower's control.<\/p>\n<\/li>\n<li data-start=\"1531\" data-end=\"1586\">\n<p data-start=\"1534\" data-end=\"1586\">Mechanism <strong data-start=\"1543\" data-end=\"1558\">force majeure<\/strong>The project was approved by the Ukrainian Chamber of Commerce and Industry.<\/p>\n<\/li>\n<\/ol>\n<p data-start=\"1588\" data-end=\"1697\">These rules do not automatically write off the debt, but they do give <strong data-start=\"1637\" data-end=\"1655\">legal basis<\/strong> request its cancellation or revision.<\/p>\n<hr data-start=\"1699\" data-end=\"1702\" \/>\n<h2 data-start=\"1704\" data-end=\"1772\"><strong data-start=\"1707\" data-end=\"1772\">2. The position of banks: why are they in no hurry to write off loans?<\/strong><\/h2>\n<p data-start=\"1774\" data-end=\"1877\">Banks usually take a conservative stance and continue to accrue debt, explaining that:<\/p>\n<ul data-start=\"1878\" data-end=\"2121\">\n<li data-start=\"1878\" data-end=\"1936\">\n<p data-start=\"1880\" data-end=\"1936\">the agreement does not contain grounds for automatic write-off;<\/p>\n<\/li>\n<li data-start=\"1937\" data-end=\"2020\">\n<p data-start=\"1939\" data-end=\"2020\">Although war is a force majeure, it does not exempt from fulfilling monetary obligations;<\/p>\n<\/li>\n<li data-start=\"2021\" data-end=\"2121\">\n<p data-start=\"2023\" data-end=\"2121\">compensation for the destroyed property may be received in the future by the state or an international mechanism.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2123\" data-end=\"2153\">However, banks <strong data-start=\"2135\" data-end=\"2150\">are obliged to<\/strong>:<\/p>\n<ul data-start=\"2154\" data-end=\"2345\">\n<li data-start=\"2154\" data-end=\"2223\">\n<p data-start=\"2156\" data-end=\"2223\">to stop the accrual of fines and penalties (in accordance with Law No. 2120-IX);<\/p>\n<\/li>\n<li data-start=\"2224\" data-end=\"2266\">\n<p data-start=\"2226\" data-end=\"2266\">consider applications for restructuring;<\/p>\n<\/li>\n<li data-start=\"2267\" data-end=\"2345\">\n<p data-start=\"2269\" data-end=\"2345\">take into account the individual circumstances of the borrower when settling the debt.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2347\" data-end=\"2478\">In many cases, banks agree to <strong data-start=\"2389\" data-end=\"2409\">loan write-off<\/strong>if the borrower proves that the collateral has been completely destroyed.<\/p>\n<hr data-start=\"2480\" data-end=\"2483\" \/>\n<h2 data-start=\"2485\" data-end=\"2533\"><strong data-start=\"2488\" data-end=\"2533\">3. When can a loan be canceled in full?<\/strong><\/h2>\n<p data-start=\"2535\" data-end=\"2589\">The loan can be canceled if several conditions are met:<\/p>\n<h3 data-start=\"2591\" data-end=\"2644\"><strong data-start=\"2595\" data-end=\"2644\">1. Complete destruction of the mortgaged property or collateral<\/strong><\/h3>\n<p data-start=\"2645\" data-end=\"2682\">It must be documented:<\/p>\n<ul data-start=\"2683\" data-end=\"2829\">\n<li data-start=\"2683\" data-end=\"2696\">\n<p data-start=\"2685\" data-end=\"2696\">the act of the State Emergency Service;<\/p>\n<\/li>\n<li data-start=\"2697\" data-end=\"2738\">\n<p data-start=\"2699\" data-end=\"2738\">a certificate from the military administration;<\/p>\n<\/li>\n<li data-start=\"2739\" data-end=\"2773\">\n<p data-start=\"2741\" data-end=\"2773\">an inspection report of the destroyed property;<\/p>\n<\/li>\n<li data-start=\"2774\" data-end=\"2829\">\n<p data-start=\"2776\" data-end=\"2829\">data from the Register of Damaged and Destroyed Property (Action).<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"2831\" data-end=\"2882\"><strong data-start=\"2835\" data-end=\"2882\">2. Lack of possibility to restore property<\/strong><\/h3>\n<p data-start=\"2883\" data-end=\"2899\">The Bank analyzes:<\/p>\n<ul data-start=\"2900\" data-end=\"2971\">\n<li data-start=\"2900\" data-end=\"2919\">\n<p data-start=\"2902\" data-end=\"2919\">technical condition;<\/p>\n<\/li>\n<li data-start=\"2920\" data-end=\"2941\">\n<p data-start=\"2922\" data-end=\"2941\">expert evaluation;<\/p>\n<\/li>\n<li data-start=\"2942\" data-end=\"2971\">\n<p data-start=\"2944\" data-end=\"2971\">level of destruction (50-100%).<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"2973\" data-end=\"3013\"><strong data-start=\"2977\" data-end=\"3013\">3. No fault of the borrower<\/strong><\/h3>\n<p data-start=\"3014\" data-end=\"3098\">For example, if the car was destroyed by a munition, and not due to the owner's gross negligence.<\/p>\n<h3 data-start=\"3100\" data-end=\"3154\"><strong data-start=\"3104\" data-end=\"3152\">4. Borrower's application in writing<\/strong><\/h3>\n<p data-start=\"3155\" data-end=\"3221\">The bank does not write off loans \"automatically\". An official procedure is required.<\/p>\n<hr data-start=\"3223\" data-end=\"3226\" \/>\n<h2 data-start=\"3228\" data-end=\"3284\"><strong data-start=\"3231\" data-end=\"3284\">4. What documents are required to cancel a loan?<\/strong><\/h2>\n<p data-start=\"3286\" data-end=\"3345\">The borrower must collect the most complete package of evidence possible:<\/p>\n<h3 data-start=\"3347\" data-end=\"3371\"><strong data-start=\"3351\" data-end=\"3371\">For real estate:<\/strong><\/h3>\n<ul data-start=\"3372\" data-end=\"3589\">\n<li data-start=\"3372\" data-end=\"3438\">\n<p data-start=\"3374\" data-end=\"3438\">an inspection report from the local council or military administration;<\/p>\n<\/li>\n<li data-start=\"3439\" data-end=\"3477\">\n<p data-start=\"3441\" data-end=\"3477\">an act of the State Emergency Service of Ukraine on fire or destruction;<\/p>\n<\/li>\n<li data-start=\"3478\" data-end=\"3496\">\n<p data-start=\"3480\" data-end=\"3496\">photographic materials;<\/p>\n<\/li>\n<li data-start=\"3497\" data-end=\"3535\">\n<p data-start=\"3499\" data-end=\"3535\">a certificate from the Register of Destroyed Property;<\/p>\n<\/li>\n<li data-start=\"3536\" data-end=\"3570\">\n<p data-start=\"3538\" data-end=\"3570\">documents of ownership;<\/p>\n<\/li>\n<li data-start=\"3571\" data-end=\"3589\">\n<p data-start=\"3573\" data-end=\"3589\">mortgage agreement.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"3591\" data-end=\"3614\"><strong data-start=\"3595\" data-end=\"3614\">For the car:<\/strong><\/h3>\n<ul data-start=\"3615\" data-end=\"3767\">\n<li data-start=\"3615\" data-end=\"3663\">\n<p data-start=\"3617\" data-end=\"3663\">police certificate of destruction or theft;<\/p>\n<\/li>\n<li data-start=\"3664\" data-end=\"3705\">\n<p data-start=\"3666\" data-end=\"3705\">a certificate from the service station about the impossibility of repair;<\/p>\n<\/li>\n<li data-start=\"3706\" data-end=\"3748\">\n<p data-start=\"3708\" data-end=\"3748\">an expert report on total damage;<\/p>\n<\/li>\n<li data-start=\"3749\" data-end=\"3767\">\n<p data-start=\"3751\" data-end=\"3767\">pledge agreement.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"3769\" data-end=\"3787\"><strong data-start=\"3773\" data-end=\"3787\">For the bank:<\/strong><\/h3>\n<ul data-start=\"3788\" data-end=\"3898\">\n<li data-start=\"3788\" data-end=\"3835\">\n<p data-start=\"3790\" data-end=\"3835\">application for cancellation of loan obligations;<\/p>\n<\/li>\n<li data-start=\"3836\" data-end=\"3881\">\n<p data-start=\"3838\" data-end=\"3881\">a request to close the credit file;<\/p>\n<\/li>\n<li data-start=\"3882\" data-end=\"3898\">\n<p data-start=\"3884\" data-end=\"3898\">a package of evidence.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"3900\" data-end=\"3903\" \/>\n<h2 data-start=\"3905\" data-end=\"3981\"><strong data-start=\"3908\" data-end=\"3981\">5. Does compensation from the state or a future international fund have an impact?<\/strong><\/h2>\n<p data-start=\"3983\" data-end=\"4029\">Yes. If the borrower receives a refund:<\/p>\n<ul data-start=\"4030\" data-end=\"4210\">\n<li data-start=\"4030\" data-end=\"4073\">\n<p data-start=\"4032\" data-end=\"4073\">compensation may be sent to the bank;<\/p>\n<\/li>\n<li data-start=\"4074\" data-end=\"4126\">\n<p data-start=\"4076\" data-end=\"4126\">the loan can be closed at the expense of these funds;<\/p>\n<\/li>\n<li data-start=\"4127\" data-end=\"4210\">\n<p data-start=\"4129\" data-end=\"4210\">but the debt can be written off by the bank even before compensation if the property is recognized as dead.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"4212\" data-end=\"4370\">The question of the future <strong data-start=\"4232\" data-end=\"4274\">International compensation mechanism<\/strong> (the project of confiscated assets of the Russian Federation) will also be taken into account, but it is not yet fully operational.<\/p>\n<hr data-start=\"4372\" data-end=\"4375\" \/>\n<h2 data-start=\"4377\" data-end=\"4441\"><strong data-start=\"4380\" data-end=\"4441\">6. What should the borrower do if the bank refuses to write off the loan?<\/strong><\/h2>\n<p data-start=\"4443\" data-end=\"4469\">There are several ways to protect yourself:<\/p>\n<h3 data-start=\"4471\" data-end=\"4529\"><strong data-start=\"4475\" data-end=\"4527\">1. Submit a second application with additional evidence.<\/strong><\/h3>\n<p data-start=\"4530\" data-end=\"4610\">Sometimes the bank changes its position after submitting an expert opinion or additional acts.<\/p>\n<h3 data-start=\"4612\" data-end=\"4646\"><strong data-start=\"4616\" data-end=\"4644\">2. File a complaint with the NBU.<\/strong><\/h3>\n<p data-start=\"4647\" data-end=\"4693\">The regulator monitors banks' compliance with the law.<\/p>\n<h3 data-start=\"4695\" data-end=\"4727\"><strong data-start=\"4699\" data-end=\"4725\">3. Go to court.<\/strong><\/h3>\n<p data-start=\"4728\" data-end=\"4772\">The court practice already contains cases when:<\/p>\n<ul data-start=\"4773\" data-end=\"4953\">\n<li data-start=\"4773\" data-end=\"4852\">\n<p data-start=\"4775\" data-end=\"4852\">loan obligations are terminated due to the destruction of the mortgaged property;<\/p>\n<\/li>\n<li data-start=\"4853\" data-end=\"4953\">\n<p data-start=\"4855\" data-end=\"4953\">the bank has no right to demand repayment of the loan if there is no collateral and no access to the property.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"4955\" data-end=\"4958\" \/>\n<h2 data-start=\"4960\" data-end=\"5003\"><strong data-start=\"4963\" data-end=\"5003\">7. Why is legal support important?<\/strong><\/h2>\n<p data-start=\"5005\" data-end=\"5136\">Banks often deliberately delay the processing of applications or require documents that the borrower cannot physically obtain.<br data-start=\"5115\" data-end=\"5118\" \/>A lawyer helps:<\/p>\n<ul data-start=\"5137\" data-end=\"5320\">\n<li data-start=\"5137\" data-end=\"5177\">\n<p data-start=\"5139\" data-end=\"5177\">correctly prepare a package of documents;<\/p>\n<\/li>\n<li data-start=\"5178\" data-end=\"5211\">\n<p data-start=\"5180\" data-end=\"5211\">negotiate with the bank;<\/p>\n<\/li>\n<li data-start=\"5212\" data-end=\"5242\">\n<p data-start=\"5214\" data-end=\"5242\">prepare complaints to the NBU;<\/p>\n<\/li>\n<li data-start=\"5243\" data-end=\"5281\">\n<p data-start=\"5245\" data-end=\"5281\">formulate a legal position in court;<\/p>\n<\/li>\n<li data-start=\"5282\" data-end=\"5320\">\n<p data-start=\"5284\" data-end=\"5320\">achieve real debt relief.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"5322\" data-end=\"5325\" \/>\n<h2 data-start=\"5327\" data-end=\"5342\"><strong data-start=\"5330\" data-end=\"5342\">Conclusions.<\/strong><\/h2>\n<p data-start=\"5344\" data-end=\"5583\">Cancelation of loans for destroyed housing or a car is <strong data-start=\"5400\" data-end=\"5421\">real mechanism<\/strong>but it is not automatic.
