Overdue payments under supply, contract, lease, service or financial assistance agreements can significantly affect the financial stability of a business and lead to protracted conflicts between counterparties. In such circumstances, it is important to understand <strong data-start=\"555\" data-end=\"602\">legal ways to settle debts between LLCs<\/strong>and the risks and consequences of each of them.<\/p>\n<hr data-start=\"647\" data-end=\"650\" \/>\n<h3 data-start=\"652\" data-end=\"697\">Causes of debt between LLCs<\/h3>\n<p data-start=\"699\" data-end=\"769\">The most common grounds for debts between legal entities are:<\/p>\n<ul data-start=\"771\" data-end=\"1050\">\n<li data-start=\"771\" data-end=\"832\">\n<p data-start=\"773\" data-end=\"832\">failure to fulfill or improper fulfillment of contractual obligations;<\/p>\n<\/li>\n<li data-start=\"833\" data-end=\"863\">\n<p data-start=\"835\" data-end=\"863\">financial difficulties of the debtor;<\/p>\n<\/li>\n<li data-start=\"864\" data-end=\"920\">\n<p data-start=\"866\" data-end=\"920\">a dispute over the volume or quality of goods or services provided;<\/p>\n<\/li>\n<li data-start=\"921\" data-end=\"968\">\n<p data-start=\"923\" data-end=\"968\">lack of clear payment terms in the contract;<\/p>\n<\/li>\n<li data-start=\"969\" data-end=\"1002\">\n<p data-start=\"971\" data-end=\"1002\">abuse by the counterparty;<\/p>\n<\/li>\n<li data-start=\"1003\" data-end=\"1050\">\n<p data-start=\"1005\" data-end=\"1050\">force majeure, including martial law.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1052\" data-end=\"1186\">Regardless of the reasons, debts between LLCs are <strong data-start=\"1099\" data-end=\"1123\">commercial dispute<\/strong>which is subject to settlement in pre-trial or court proceedings.<\/p>\n<hr data-start=\"1188\" data-end=\"1191\" \/>\n<h3 data-start=\"1193\" data-end=\"1233\">Pre-trial settlement of debts between LLCs<\/h3>\n<p data-start=\"1235\" data-end=\"1386\">The first and most cost-effective step is to <strong data-start=\"1283\" data-end=\"1314\">pre-trial settlement of a dispute<\/strong>. It allows you to obtain a court order without summoning the parties and significantly reduces the time for debt collection.<\/p>\n<p data-start=\"3313\" data-end=\"3439\">However, the debtor has the right to file an application to set aside the court order, after which the dispute will be considered in the lawsuit.<\/p>\n<hr data-start=\"3441\" data-end=\"3444\" \/>\n<h3 data-start=\"3446\" data-end=\"3498\">Enforcement proceedings and actual debt collection<\/h3>\n<p data-start=\"3500\" data-end=\"3677\">Obtaining a court decision does not always mean an automatic refund.
